Our constitution is specifically written to prevent the executive branch of government from creating legislation. It is unconstitutional for the president to create any new spending program without a supporting bill passing both houses of congress.

It is easy to find the “separation of powers” doctrine that prevents the president from creating legislation it is describe in the first article:
Article. I.
Section. 1.
All legislative Powers herein granted shall be vested in a Congress of the United States, which shall consist of a Senate and House of Representatives.
